Colorado replaced its earlier AI framework; buyers should not implement a checklist based solely on SB24-205. SB26-189, signed 14 May 2026, repeals and reenacts those provisions around automated decision-making technology that materially influences consequential decisions. Its principal new requirements start 1 January 2027. (leg.colorado.gov)
For covered parties, the enacted summary describes developer documentation, material-update notifications, compliance-record retention, consumer notices, data correction and meaningful human review. It also expressly recognises exemptions associated with other legal obligations. Therefore, “insurance is a listed domain” does not by itself establish that every carrier, affiliate and production supplier has identical duties. (leg.colorado.gov)
The near-term milestone is rulemaking. The attorney general released an interim draft on 6 October 2026; the hearing and current comment deadline are 26 October 2026, with the comment period continuing if the hearing extends beyond that date. Those rules remain proposed at this cut-off. (coag.gov)
Recommended action before the hearing: commission a written applicability analysis for the actual entities and workflow. It should identify:
- Which organisation develops the technology and which deploys it.
- Whether the output materially influences a covered decision rather than performing only incidental or clerical work.
- Which exemption or sector-specific route is being relied upon, and its conditions.
- What evidence and assistance the supplier must provide even where the carrier has a different regulatory route.
The insurer-specific exemption analysis was not completed in this research pass. Do not treat this section as a determination that a particular production arrangement is covered or exempt.
